A Title 5 Inspection is a state regulation that governs the design, construction and maintenance of septic systems in Massachusetts. The purpose of the Title 5 Inspection in to assess the condition of the septic system and determine if it is capable of protecting public health and the environment.


The inspection is necessary when a property with a septic system is being sold, transferred or undergoing a change in use that requires a building permit. It is also required for properties with systems that are over a certain age or have a design flow greater than 10,000 gallons per day.

Title 5 Inspection Results

Bay State Sewage Disposal is here to help you every step of the way through your Title 5 Inspection. After inspection is completed, there are three possible outcomes:


  • Pass - The septic system is in good working order and meets all Board of Health requirements.
  • Conditional Pass - The septic system has some component that does not meet Board of Health requirements, such as a tank leak or broken baffle. Once the septic system has been repaired, a new report will be submitted showing the system has passed inspection.
  • Fail - The septic system does not meet Board of Health requirements. If the system is not a threat to public health, you will have 2 years to complete all necessary work. If your septic system is found to be a threat to public health, you will be required to repair or replace the entire system within a designated timeframe provided to you by the inspector.
